These Terms of Service ("Terms") apply to your use of kingswaydecor.com (the "Website") and to any purchase you make from us. The Website is operated by Kingsway Decor ("we", "us", "our"), a business based in Willagee, Western Australia. By using the Website or placing an order, you agree to these Terms. Please read them carefully.

1. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.

2. Using the Website

You must be at least 18 years old to place an order, or have the permission of a parent or guardian. You agree to provide accurate and complete information when placing an order, and to use the Website only for lawful purposes.

3. Products

We take care to describe and photograph our products accurately. However, colours may appear slightly different depending on your screen, sizes are measured by hand and may vary by 1-2cm, and some lifestyle photos include styling items that are not part of the product. Please check the product description for exactly what is included (for example, cushion covers are sold without inserts).

4. Prices and payment

All prices are shown in Australian dollars (AUD) and include free shipping within Australia. Kingsway Decor is not currently registered for GST, so no GST is charged. Payment is taken in full at checkout through our secure payment provider. The price you pay is the price shown at checkout when you place your order. We may change prices at any time, but changes will not affect orders already placed.

5. Orders

Your order is an offer to buy. We accept it when we dispatch the goods. We may decline or cancel an order if a product is unavailable, if there is an obvious error in the price or description, or if we suspect fraud. If we cancel your order, we will refund you in full.

If you need to cancel or change your order, email us as soon as possible. We will do our best to help, but we may not be able to change an order once it has been processed for dispatch.

6. Shipping and delivery

We ship within Australia only. Orders are processed within 1-3 business days and most arrive within 7-15 business days. Delivery times are estimates and are not guaranteed. Full details are in our Shipping Policy. Risk in the goods passes to you when they are delivered to the address you provide. Please make sure your delivery address is correct.

7. Returns and refunds

Change-of-mind returns are accepted within 30 days of delivery, as set out in our Refund & Returns Policy. Faulty, damaged or incorrect items will be replaced or refunded in line with the Australian Consumer Law.

8. Safe use of products

Please follow the instructions and warnings supplied with each product. In particular:

Keep products containing batteries or small parts out of reach of young children.
Solar and battery-powered lights are designed for the weather rating shown in the product description and must not be submerged in water.
Do not use products for any purpose other than their intended use.

9. Promotions and discount codes

Discount codes and promotions are subject to the conditions stated with them. Unless stated otherwise, only one code can be used per order, codes cannot be exchanged for cash, and they cannot be applied to past orders.

10. Reviews and content you submit

If you submit a review, photo or other content, you confirm it is honest, is your own, and does not break any law. You give us permission to display it on the Website and our social media. We may remove content that is offensive, misleading or unrelated to the product.

11. Intellectual property

All content on the Website, including text, images, logos and design, belongs to Kingsway Decor or its licensors. You may not copy or reuse it for commercial purposes without our written permission.

12. Limitation of liability

Subject to the Australian Consumer Law and to the extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of the Website or our products. Where our liability for goods that are not of a kind ordinarily acquired for personal, domestic or household use can be limited, it is limited to replacing or repairing the goods, or refunding the price paid.

13. Circumstances beyond our control

We are not responsible for delays or failure to perform caused by events outside our reasonable control, such as carrier delays, severe weather, natural disasters or supply disruptions. If this happens, we will keep you informed and offer a refund if we cannot fulfil your order.

14. Privacy

We handle your personal information in line with our Privacy Policy and the Privacy Act 1988 (Cth).

15. Third-party links

The Website may contain links to other websites. We are not responsible for the content or practices of those websites.

16. Changes to these Terms

We may update these Terms from time to time. The version shown on the Website at the time you place your order applies to that order.

17. Governing law

These Terms are governed by the laws of Western Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Western Australia.
